Liability Waiver & Release Agreement – Jimmy Rig Charters, LLC
Operating in Rhode Island & Massachusetts

READ CAREFULLY — THIS IS A LEGALLY BINDING DOCUMENT. By booking a trip or boarding any vessel operated by Jimmy Rig Charters, LLC, you acknowledge that you have read, understand, and agree to be bound by the terms of this Liability Waiver and Release Agreement.

Participant understands that fishing and boating activities involve inherent and substantial risks, including but not limited to injury or death from drowning, falling overboard, collision, capsizing, or equipment failure; exposure to weather conditions including wind, waves, lightning, and sun; slippery decks and injuries from hooks, knives, and fishing gear; injuries caused by marine life or other passengers; and risks such as seasickness, fatigue, dehydration, or physical exertion. Participant voluntarily assumes all risks, known and unknown, associated with participation in these activities.

To the fullest extent permitted by law, Participant hereby releases, waives, discharges, and covenants not to sue Jimmy Rig Charters, LLC, its owners, captains, crew members, employees, contractors, and agents from any and all liability, claims, demands, or causes of action for injury, illness, death, or property damage arising out of or related to participation in any charter activities, including those caused by the negligence of the released parties.

Participant agrees to indemnify, defend, and hold harmless Jimmy Rig Charters, LLC from any claims, damages, or expenses, including legal fees, arising out of Participant’s actions or omissions, failure to follow safety instructions, or violation of applicable laws while aboard the vessel.

Participant acknowledges that the Captain has full authority over the vessel, all passengers, and all trip-related decisions, including the right to cancel or terminate the trip due to safety or weather conditions. Participant agrees to follow all instructions provided by the Captain and crew at all times and understands that failure to comply may result in removal from the charter without refund.

Participant certifies that they are physically able to participate in these activities and understand that emergency medical care may be delayed due to the offshore or marine environment. Participant accepts all risks related to medical conditions and delayed treatment.

Participant agrees that Jimmy Rig Charters, LLC is not responsible for loss, theft, or damage to personal belongings brought aboard the vessel.

The use of illegal drugs is strictly prohibited. The Captain reserves the right to deny boarding or terminate the trip without refund for unsafe behavior, intoxication, or violation of any rules.

This Agreement shall be governed by and construed in accordance with the laws of the State of Rhode Island and the Commonwealth of Massachusetts. If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

By participating in any charter activity, the Participant acknowledges that they have read and fully understand this Agreement, and that they are voluntarily giving up certain legal rights, including the right to sue.
